is a process designed to help individuals and families resolve their disputes and regain self confidence and personal control. The goal is to find mutually satisfactory solutions, not to declare winners or losers.
Team Mediation at Human Resource Associates
is a cooperative process designed to assist parties in making effective decisions during their marital dissolution. Team Mediation allows the couple to determine their destiny, rather than heir future being determined by "the system". The win-win approach of mediated agreements preserves the positive aspects of the family and makes the agreements made during the mediation more acceptable to all parties.
The First Step
in the team mediation process is a meeting with the divorcing couple and two mediation counselors to jointly review the process. The couple is informed about the information and documents necessary to begin working toward the completion of a final divorce agreement.
If an agreement can be finalized, the couple will sign a proposed judgment of divorce and be encouraged to take it to two separate attorneys before final approval by a judge.
The Team Mediation Session
is a 3 hour meeting in which the couple attempts to resolve challenging issues with the help of the mediation team. The object of the intensive session is to resolve the dispute issues in the time allotted and draft a written agreement. Couples who are truly committed to preserving an amicable relationship often display surprising creativity in developing mutually agreeable solutions for the challenging issues of their divorce.
Since divorce is an emotionally charged process, road blocks can occur during a mediation session. When the mediators see that a break is needed, a "caucus" is called. Each spouse meets separately with a mediator to work out their concern in private. This unique approach diffuses potentially volatile situations, and allows the couple to continue mediation on a productive path toward resolution.
What can be resolved?
The mediation process can help resolve issues such as custody, parenting, child support, spousal support, and the division of property.
Team Mediation is not for everyone
If an agreement cannot be reached at the end of the 3 hour session, the mediation therapists meet to determine whether an additional mediation session would be helpful. If not, the couple is advised to obtain separate counsel.
